This notice is being provided on behalf of Gateway One Lending & Finance, LLC (G.O.L.F.). We value our customers’ privacy and, as required by law, the following describes important information regarding how we collect public and nonpublic personal information, how the information is disclosed, and your rights to opt-out of us disclosing certain information. Please review this information carefully.

INFORMATION WE MAY COLLECT ABOUT YOU

We collect nonpublic personal information about you from the following sources:

  • Information we receive from you on an application or other forms. For example, identification and contact information, income, assets, and references;
  • Information about your transactions with us, our affiliated companies, or others. For example, your loan balance and payment history;
  • Information we receive from a consumer reporting agency. For example, information about your credit history; and
  • Information you submit to our Web site. For example, if you have enrolled and are signed in, you can review your information and submit changes to your contact information. You may do this by clicking on the “Update Info” button. You may also provide information to make your contract payments through our Web site.

INFORMATION WE MAY DISCLOSE TO OUR AFFILIATED COMPANIES:

We may disclose the nonpublic personal information that we collect about you, as described above, with our affiliated companies. Affiliates are companies related by common ownership or control. They can be financial and non-financial companies. Our affiliates are companies such as banks, finance companies, insurance agencies, brokerage companies, leasing companies, and equipment and inventory financing companies under the common ownership of TCF Financial Corporation.

To Limit Our Sharing with Affiliates. We always have the right to share identifying and contact information from your application and information about our experiences with your transactions and accounts with our affiliated companies. If you prefer that we NOT disclose other information that we may obtain, such as the information from consumer reporting agencies to affiliated companies, you may elect to opt-out of these disclosures; that is, you may direct us not to make those disclosures (other than disclosures permitted by law) by calling us toll free at (877) 465-3044.

INFORMATION WE MAY DISCLOSE TO OTHER COMPANIES:

We may disclose the following kinds of nonpublic personal information that we collect about you with nonaffiliated companies:

  • Information we receive from you on an application or other forms such identification and contact information, income, assets, and references; and
  • Information about your transactions with us, our affiliated companies, or others, such as your loan balance and payment history.

We may share nonpublic personal information about you with the following types of third-parties who are not affiliates:

  • Financial service providers, such as insurance companies, banks, and other finance companies; and
  • Nonfinancial companies, such as automobile dealers, other retailers, and direct marketers.

JOINT ACCOUNTHOLDERS

If you and one or more customers jointly obtain a financial product or service from us (“joint accountholders”), we will apply an opt-out instruction that we receive from any joint accountholder to all joint accountholders on that account with respect to that account. Any joint accountholder may exercise this opt-out right.

INFORMATION WE MAY DISCLOSE FOR SERVICE AND JOINT MARKETING REASONS

We may disclose nonpublic personal information about you to nonaffiliated third parties for service and joint marketing reasons, as permitted by law.

Sharing Your Information with Service Providers. We may hire nonaffiliated companies to provide materials or to perform services on our behalf. Our service providers are not permitted to use any information that we share with them about you for any purpose other than to perform those services.

Sharing Your Information for Joint Marketing. We may hire nonaffiliated companies to perform marketing services on our behalf or to other financial institutions with whom we have joint marketing arrangements. Currently, there are no servicing or marketing arrangements, but GOLF reserves the right to enter into such arrangements in the future.

We may always share your nonpublic personal information as described in this section for service and joint marketing reasons, when permitted by law. You may not opt-out of us sharing this information.

INFORMATION WE DISCLOSE WHEN PERMITTED OR REQUIRED BY FEDERAL OR STATE LAW

We may share your information with other parties when permitted or required by federal or state law. For example, we share information in order to protect against fraud, report transaction to consumer reporting agencies, respond to subpoenas, and when you ask us to.

We may always share your nonpublic personal information as described in this section when permitted or required by law. You may not opt out of us sharing this information.

SHARING INFORMATION ABOUT FORMER CUSTOMERS

If you have an inactive or closed account(s) with us, we will continue to adhere to the policies and practices described in this Notice.

CONFIDENTIALITY AND INFORMATION SECURITY

We restrict access to nonpublic personal information about you to those individuals who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

CHANGES TO THE POLICY

We reserve the right to modify or supplement this privacy policy. If material changes are made, we will provide a revised policy to all current customers.

OTHER IMPORTANT INFORMATION

California Residents
We will not share any of the personal information that we collect about you with affiliated or nonaffiliated or marketing companies without your express written consent, except as otherwise explained in this Notice.

Texas Residents
G.O.L.F. is licensed and examined under the laws of the State of Texas and by state law is subject to regulatory oversight by the Office of Consumer Credit Commissioner. Any consumer wishing to file a complaint against G.O.L.F. should contact the Office of Consumer Credit Commissioner through one of the means indicated below:

Vermont Residents
We will not disclose personal information about you to our affiliates (other than information about your transactions with us and our affiliates) unless you have given us your authorization in accordance with applicable law, or except as otherwise permitted by applicable law.

G.O.L.F. is an indirect consumer automobile sales finance company taking assignment of retail installment contracts from motor vehicle dealerships throughout the country.
